Our Terms.
Scope of Agreement
This document outlines the terms of service, forming a rental agreement between Lemon Juice GmbH ("Lemon Juice") and the client ("user"), who receives a rental charger. This agreement is facilitated through designated rental stations for pick up and return. These terms are applicable to all users, whether they have registered with Lemon Juice or not. Lemon Juice alone is responsible for all duties towards the user arising from these terms, and not the Point of Sale. The Points of Sale act as trusted agents, providing Lemon Juice's services on their behalf.
Duration of Rental Service
The rental contract between Lemon Juice and the user is considered effective upon the user's receipt of the rental charger. The rental period is capped at a maximum of 18 days. Should the user not return the rental charger within this 18-day period, the contract ends automatically. In such cases, ownership of the charger transfers to the user, and any deposit paid is kept in full by Lemon Juice. The user may conclude the rental contract by returning the charger and settling any accumulated late fees.
Rental Fee
Typically, the cost for renting a charger is CHF 3.00 (VAT included). This fee is subject to change based on promotional offers or price revisions. The rental fee confirmed at the start of the agreement remains applicable. By paying this fee, the user is entitled to use the charger's power and the charger itself for a total of 3 days, starting from the day of receipt.
Deposit
Users are required to provide a security deposit of CHF 15.00 for the charger during the rental period. This deposit will be fully refunded upon the return of the charger a in its original, undamaged condition within the specified 3-day rental period. It's important to note that this deposit is exclusive of any value-added tax.
Late Fee
In cases where the user does not return the charger within the initial 3-day rental term, a late fee of CHF 1.00, inclusive of VAT, will be charged for each additional day. This fee will be subtracted from the previously paid deposit.
Transfer of Ownership after 18 Days
Should the user not return the charger within 18 days of pick up, ownership of the charger will automatically transfer to the user. In this case, Lemon Juice will retain the rental fee and full deposit as the purchase price. Lemon Juice will also cover the VAT on the retained deposit amount.
Guidelines and Prohibition of Misuse
The rental charger provided by Lemon Juice is intended exclusively for charging standard smartphones, mobile phones, tablets, and vapes. Users are expected to use the charger responsibly, in accordance with its intended purpose, and to safeguard it against improper use. It is imperative that the rental chargers are not misused. Misuse includes, among other things, intentional contamination or damage to the charger or label, as well as any unauthorized technical alterations or incorrect handling of the rental charger.
Liability
Users are responsible for any loss or damage to the charger, with liability capped at the value of the deposit. Lemon Juice is not liable for any harm or damage resulting from a customer's misuse of the rental charger, whether to themselves, their smartphone (or other devices), or to others, whether such misuse is intentional or negligent.
Return of the Rental Charger
Users can return the rental charger to any of our charging stations at all times, day or night.
Refund of Deposit
Upon return of the rental charger, the remaining deposit will be refunded electronically. If Lemon Juice staff identify potential damage to the charger, as outlined in item 10 (such as harm to the charger or label), the repayment of the deposit will be delayed until a thorough inspection of the charger is completed. In such instances, a support ticket will be issued, which entitles the user to receive the pending deposit after getting in touch with Lemon Juice and following our review. The evaluation of the charger and the subsequent return of any remaining deposit will be completed within a maximum of 60 days from the date of the charger's return.

Changes to Terms
Lemon Juice reserves the right to modify these terms of use at any time. The most current version of the terms can always be found at www.charge-lemon.ch/terms.
Data Protection
All data collected in the course of providing our services will be handled, processed, and utilized in compliance with the Swiss Federal Data Protection Act. User data will be exclusively used by Lemon Juice and will not be shared with external parties. Guaranty & Warranty
In the event that the rental charger is found to have a technical fault, Lemon Juice offers an option to either exchange it at no additional cost or to provide a refund for the charges, provided this is done within 10 minutes of pick up. After the initial 10 minutes, only the security deposit, but not the rental fee, is eligible for reimbursement at the pick up location. Should you seek to reclaim the rental fee under these circumstances, you are required to directly contact Lemon Juice's support team. We advise users to promptly check the charger's functionality upon pick up. Any further claims related to damages or defects are hereby excluded. Any warranty provided becomes void if the charger is used improperly or intentionally damaged by the customer.
Applicable Law & Place of Jurisdiction
Any legal disputes that arise between the user and Lemon Juice under this agreement will be governed by Swiss law. The jurisdiction for any such disputes shall be the courts of the Canton of Aargau.
Severability Clause
In the event that any part of this agreement is found to be invalid, incomplete, or unenforceable, such a situation will not impact the enforceability of the other provisions of the agreement. Any such invalid or unenforceable provisions will be substituted with the appropriate legal provisions.
